1. Acceptance of Terms

By accessing or using the Interstate Bridge Monitor service ("Service") at i5bridgestatus.com ("Website") or our mobile applications ("Apps"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Interstate Bridge Monitor provides real-time monitoring of the I-5 Interstate Bridge over the Columbia River, including bridge lift status, traffic conditions, and historical data. The Service includes:

• Free web-based bridge status monitoring
• Optional paid SMS alert notifications (via website)
• Optional paid push notification alerts (via iOS and Android apps)
• API access for developers (where applicable)

3. Data Sources and Accuracy

Our Service aggregates data from third-party sources including the Washington State Department of Transportation (WSDOT) and other traffic data providers. While we strive to provide accurate and timely information:

• We do not guarantee the accuracy, completeness, or timeliness of any information provided.
• Data may be delayed, incomplete, or contain errors.
• Bridge lift status and traffic conditions can change rapidly and without notice.
• You should always verify critical information through official sources before making travel decisions.

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We expressly disclaim all warranties including, but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy or reliability of any information obtained through the Service

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL I5BRIDGESTATUS.COM, ITS OWNERS, OPERATORS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage
• Damages arising from your use of or inability to use the Service
• Damages arising from any decisions made based on information provided by the Service

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

6. Subscription Services

We offer paid subscription services for bridge lift notifications through multiple platforms:

6.1 SMS Alert Service (Web)

• Subscription Fee: $4.99 per year, billed annually.
• Message Frequency: Message frequency varies based on bridge lift activity. You may receive multiple messages per day during periods of high bridge activity.
• Carrier Charges: Standard message and data rates from your mobile carrier may apply.
• Opt-Out: You may cancel at any time by replying STOP to any message or through your account settings.
• Delivery: We do not guarantee delivery of SMS messages. Messages may be delayed or undelivered due to carrier issues, network problems, or other factors beyond our control.

6.2 Mobile App Push Notifications (iOS & Android)

• Subscription Fee: $8.99 per year.
• Billing: Subscriptions are billed through Apple (App Store) or Google (Play Store) and are subject to their respective terms and conditions.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: You may cancel your subscription at any time through your device's subscription settings:
  • iOS: Settings → Apple ID → Subscriptions
  • Android: Play Store → Menu → Subscriptions
• Refunds: Refunds are handled by Apple or Google according to their respective refund policies. We do not process refunds directly for app subscriptions.
• Features: App subscribers receive push notifications, customizable quiet hours, weekday-only alerts, minimum lift duration filters, and lift history access.
• Delivery: We do not guarantee delivery of push notifications. Notifications may be delayed or undelivered due to device settings, network issues, or platform limitations.

6.3 General Subscription Terms

• Subscription fees are non-refundable except as required by applicable law or platform policies.
• We reserve the right to change subscription pricing with reasonable notice to existing subscribers.
• Free trials, if offered, will automatically convert to paid subscriptions unless cancelled before the trial ends.
• Subscriptions are for personal, non-commercial use only.

7. User Responsibilities

By using the Service, you agree to:

• Provide accurate information when creating an account or subscribing to services
• Maintain the confidentiality of your account credentials
• Use the Service only for lawful purposes
• Not attempt to interfere with or disrupt the Service
• Not use automated systems to access the Service without our express permission
• Not resell or redistribute the Service without authorization

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by i5bridgestatus.com or its licensors and are protected by copyright, trademark, and other intellectual property laws.

9. Third-Party Services

The Service may contain links to or integrate with third-party services, including but not limited to Apple App Store, Google Play Store, and payment processors. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

10. Indemnification

You agree to indemnify, defend, and hold harmless i5bridgestatus.com, its owners, operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or violation of these Terms.

11. Modifications to Service and Terms

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time without notice
• Update these Terms at any time by posting the revised version on the Website
• Change pricing for paid services with reasonable notice to subscribers

Your continued use of the Service after any changes constitutes acceptance of the modified Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Multnomah County, Oregon.

13. Dispute Resolution

Before initiating any legal action, you agree to first contact us to attempt to resolve any dispute informally. If we cannot resolve the dispute within 30 days, either party may proceed with legal action as provided in these Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and i5bridgestatus.com regarding your use of the Service and supersede all prior agreements and understandings.
